Legal Notice
This legal notice applies to the macaisse.net website (public site, merchant area, reseller area and administration area) as well as to the MaCaisse point-of-sale application installed on Android and iOS tablets.
1. Publisher of the website and application
The macaisse.net website and the MaCaisse application are published by a company incorporated under Moroccan law:

Business model. MaCaisse is point-of-sale software offered on a paid subscription basis. The subscription is taken out and paid for solely on the macaisse.net website (merchant area, “Subscription” section), never from the mobile application.
Prices and currency. Prices are stated and invoiced in Moroccan dirhams (DH). Where payment is made online via PayPal, the amount in DH is converted into euros by the Publisher, at a rate that the Publisher sets itself and may change over time; that rate and the corresponding amount in euros are displayed before the payment is confirmed. PayPal plays no part in this conversion; it may, however, apply its own fees or its own exchange rate if your account or your card is denominated in a currency other than the euro.

3. Hosting
The macaisse.net website, the merchant area and the API used by the tablets are hosted on a virtual private server (VPS) rented by the publisher from:

It is on this server that the data synchronised from the point-of-sale terminals is stored (catalogue, sales, the merchant's customer records, settings), as well as the subscription billing data. The publisher also uses a limited number of technical service providers for specific features: an artificial-intelligence provider for menu import from a photo and for the image bank, the PayPal payment gateway, a delivery-order gateway, and an e-mail sending service (Namecheap, Inc. (serveur SMTP server191.web-hosting.com), United States) for verification codes and service messages. These providers, the data transmitted to them and their location are set out in detail in the privacy policy.

5. Intellectual property
The macaisse.net website, the MaCaisse application, their source code, their interfaces, their databases, their texts, illustrations, icons, page layouts and documentation are the property of SAGATEC — Société d’informatique, domotique et sécurité or are covered by a licence to use granted for its benefit. They are protected by Law No. 2-00 on copyright and related rights and by the applicable international conventions.
The subscription grants the merchant a personal, non-exclusive and non-transferable right to use the software, for the term of their subscription and within the limit of the number of tablets subscribed for. The following are prohibited in particular, unless the publisher has given prior written authorisation:
- reproducing, distributing, reselling, renting out or making available all or part of the software or the website;
- decompiling, disassembling or reverse-engineering, other than in the cases permitted by law;
- extracting or substantially re-using the content of the databases;
- removing or altering ownership notices, logos and licence numbers;
- using the content of the MaCaisse image bank outside the software.
The image bank supplied with the product is made available to subscribing merchants on a read-only basis, in order to illustrate their catalogue within MaCaisse.
Partner resellers are authorised to use the MaCaisse name and marketing materials strictly within the scope of the distribution agreement binding them to the publisher.
6. Trademarks and distinctive signs
“MaCaisse”, the domain name macaisse.net and the associated logo are distinctive signs used by SAGATEC — Société d’informatique, domotique et sécurité. Any reproduction or use, in whole or in part, without prior written authorisation is prohibited.
The other trademarks, product names and logos that may be mentioned (in particular PayPal, Glovo, Alibaba Cloud, Google, Apple, Android, Microsoft SQL Server, as well as the open-source technologies used, such as Flutter, Laravel, PostgreSQL, SQLite, Nginx or Tailwind CSS) belong to their respective owners and are mentioned for technical information purposes only. Mentioning them implies no partnership, sponsorship or endorsement other than the contractual relationships described in the privacy policy.
7. Content uploaded by merchants
The subscribing merchant remains the owner of the content and data that they enter or photograph in MaCaisse: catalogue and item photos, the logo and contact details of their business, their customer records, their sales history, and the records of their employees and suppliers. The publisher hosts and processes them on the merchant's behalf, for the sole purpose of operating the service.
The merchant warrants that they hold the necessary rights in the content they upload (images, texts, their suppliers' trademarks) and that they comply with the regulations applicable in respect of their own customers and their employees. They undertake not to use the service to host unlawful content.
Reporting. Any manifestly unlawful content accessible through the service may be reported to info@sagatec.ma, stating the URL or the account concerned and the reason for the report. The publisher does not carry out general monitoring of the content hosted on behalf of its customers.
8. Personal data
The processing of personal data is governed by the Moroccan loi n° 09-08 (Law No. 09-08 on the protection of natural persons with regard to the processing of personal data) and by the decisions of the Commission Nationale de contrôle de la protection des Données à caractère Personnel (CNDP) (the Moroccan national data protection authority). Allocation of roles:
- SAGATEC — Société d’informatique, domotique et sécurité is the data controller for the data relating to the merchant's account: identity and contact details, billing information (ICE, address, telephone), registered tablets, subscription invoices and payments, and technical and security logs.
- The merchant is the data controller for the data of their own customers (customer records, loyalty, credit accounts, receipts) and of their point-of-sale employees. SAGATEC — Société d’informatique, domotique et sécurité then acts solely as a data processor, on the merchant's instructions, in order to host and synchronise that data.
Formalities incumbent on the merchant. It is for the merchant to complete, for their own processing activities, the formalities required by the loi 09-08. MaCaisse identifies point-of-sale employees by their CIN number (Moroccan national identity card number): this data is regarded as sensitive under the loi 09-08, and its processing may require prior authorisation from the CNDP — and not merely a declaration. The merchant alone judges whether it is appropriate to fill in this field and remains responsible for the corresponding formalities, as well as for informing their employees and their customers.
The purposes, the recipients, the technical service providers, the retention periods and the arrangements for exercising rights (access, rectification, objection, deletion) are set out in detail in the privacy policy.
Where users located in the European Union are concerned, the publisher endeavours, as a voluntary commitment, to apply the principles of the General Data Protection Regulation (GDPR). No GDPR compliance certification is claimed.
9. Account and data deletion
The merchant can delete their MaCaisse account themselves, from the application: side menu › “Cloud account” › red “Delete my account” button at the bottom of the screen. A dialog box sets out the consequences, asks for the MaCaisse account password (the website password, not the point-of-sale password), and deletion is then confirmed with “Delete permanently”. The operation is immediate: there is no cooling-off period, no web form and no confirmation e-mail to validate.
In practical terms, the operation combines erasure and anonymisation:
- genuinely erased are the shops and all of their synchronised content (sales, sales lines, payments, items, categories, end-customer records, salespeople, roles, VAT, settings), as well as the tablets and their access tokens, and the subscriptions;
- the account record remains, but emptied of all personal data: name, company, billing details, ICE and telephone number are cleared, and the password is replaced with a random value. It now serves only to link the accounting documents;

the real e-mail address is released: it is replaced by a technical address at
@macaisse.invalid. The merchant can therefore sign up again later with the same address; - subscription invoices and receipts (FAC-, REC-) are retained, pursuant to accounting and tax obligations. Those documents contain a snapshot of the billing details as they appeared at the time they were issued, including the frozen e-mail address: after deletion, those items therefore remain in the accounting records.
A deletion request may also be sent by e-mail to info@sagatec.ma; it is processed within a maximum of 30 days. Details of the procedure are given on the Account and data deletion page.
10. Cookies and trackers
macaisse.net uses only cookies that are strictly necessary for it to work. No advertising cookie, no audience-measurement cookie and no third-party profiling tracker is placed. There is therefore no consent banner: these technical cookies are essential to the service and cannot be disabled without preventing login.

On the server side, the session records the identifier of the logged-in account, the IP address and the browser user-agent, for operational and security purposes. Failed login and activation attempts are also logged with the IP address and e-mail address concerned, for protection against intrusion attempts. These technical logs are not subject to automatic rotation: they are purged periodically, during server maintenance operations. These matters are described in the privacy policy.
Resources loaded from third-party servers. The pages of the website load fonts from
Google Fonts (fonts.googleapis.com, fonts.gstatic.com) and the Tailwind CSS
style sheet from cdn.tailwindcss.com. These calls are not used to track you and transmit
no data from your business; technically, however, they mean that your browser contacts these providers
directly, and that they thereby receive your IP address, your user-agent and the address of the page
viewed. These resources are not yet self-hosted.
Mobile application. The MaCaisse application does not use cookies and does not embed any statistics or advertising tools. It does, however, keep data on the tablet itself (local point-of-sale database, service access token, preferences), in the application's private storage area.
11. External links and resources
The website and the application may link to third-party sites (in particular the PayPal payment page when paying for a subscription). The publisher exercises no control over those sites and accepts no liability for their content, their availability and their own data practices. Visiting those sites is governed by their own terms of use.
12. Service availability and liability
The publisher uses reasonable means to ensure the accessibility and accuracy of the service, without guaranteeing uninterrupted availability: interruptions may occur for maintenance, updates, technical incidents or acts of a third party (host, operator, payment gateway).
The point-of-sale application works in local offline mode: it continues to take payments without a connection, then synchronises the data to the server once the connection is restored. The merchant remains responsible for the good working order of their equipment, for the security of their tablets and of the passwords used at the point of sale — a password is set at installation, and it is for the merchant to change it and keep it confidential — as well as for retaining their accounting records in accordance with the regulations applicable to them.

13. Governing law and jurisdiction
This legal notice is governed by Moroccan law. As the service is reserved for professionals acting in the course of their business, failing an amicable settlement, any dispute relating to the website or the application shall fall within the exclusive jurisdiction of the Commercial Court of Meknès, Morocco.
14. Amendments to this legal notice
This legal notice may be amended to take account of changes in the service, in the publisher's organisation or in the applicable regulations. The version in force is the one published on macaisse.net, identified by the last-updated date shown at the top of the page; it is for you to consult it periodically.
